The petitioner, an auction purchaser, pursuant to the auction conducted by the 3rd respondent seeks dismissal of Regular Civil Suit No.17 of 2021 that has been filed by the 2nd respondent challenging the Deed of Mortgage executed by the 4th respondent in favour of the 3rd respondent - Bank. It is urged that pursuant to the aforesaid auction, the petitioner has paid the entire sale consideration and has been issued a sale confirmation letter on 28th November 2024.

Issue notice to the respondents, returnable on 20th March 2025. Ms. Purnima Awasthi, learned counsel waives notice for respondent no.1 and Mr. Rishi Thakur, learned counsel waives notice for respondent no.3. Other respondents be duly served.
