Present writ petition takes exception to the order dated 27.1.2025 passed by the learned Civil Judge S.D. Ahmednagar below Exhibit-30 in R.C.S. no.456 of 2023, by which application filed by the respondents for appointment of the Court Commissioner has been allowed.

Learned counsel appearing for the respective parties extensively argued the matter. At the conclusion, Mr. Kakade, learned counsel appearing for respondent nos.4,5,6,8,9 and 11, on instructions, submits that respondents would not press the application Exhibit-30 with liberty to move the application for same relief after recording of the evidence.

In that view of the matter, writ petition is partly allowed. The order impugned is quashed and set aside with liberty in favour of the respondents, as prayed.

The trial Court to expedite hearing of the suit and endeavour to decide the same within a period of one year from today. Parties to cooperate.
