It is submitted by the learned counsel for the petitioner that 5th respondent having been admitted at Vedanta Medical College, Palghar at the "M.D.-General Medicine" course desires to retain the said seat as per his communication dated 19th February 2025 (page 21 of the writ petition). The petitioner claims entitlement to a seat in the subject of "M.D.-General Medicine" which is available at Bharti Vidyapeeth Medical College & Hospital, Sangli. According to the petitioner, the seat allotted to 1/2 905-WP-2873-2025.doc Dixit

the respondent no.5 in the stray vacancy round at the Bharti Vidyapeeth Medical College & Hospital, Sangli is liable to be allotted to the petitioner. 3.

Issue notice to the respondents, returnable on 6th March 2025. The respondents be served through all permissible modes. 4.

In the meanwhile, without prejudice to the rights and contentions of either parties, the petitioner is permitted to report at the Bharti Vidyapeeth Medical College & Hospital, Sangli for the seat available in "M.D.-General Medicine". It is made clear that the petitioner shall not claim any equity on the strength of this interim direction. 5.
