In that view of the matter, no serious error can be traced in the order passed by the Labour Court refusing to grant stay to the show cause notice. The Industrial Court has rightly rejected revision filed by the Petitioner by relying upon judgment of this Court in Dagdu Vasant Mudgal V/s. Maharashtra State Road Transport Corporation1 I therefore, do not find any valid ground to interfere in the orders passed by the Labour and the Industrial Court.

3) Reserving the liberty to the Petitioner to file a fresh complaint challenging the punishment order if and when imposed, the Petition is accordingly disposed of. 4) Petitioner would be at liberty to file reply to the show cause notice within a period of three weeks.
