The writ petition arises out of proceedings under Section 70(b) of the Maharashtra Tenancy and Agricultural Lands Act, 1948.

On perusal of the record, it appears that the status of the petitioner for the area ad-measuring 91 Guntha of land bearing Survey No.203/9A at Village Kalsavli, Taluka Rajapur, District Ratnagiri was the subject-matter before the Maharashtra Revenue Tribunal. However, rest of the area of 41 Guntha out of 1-Hectare 32-Are was not the subject-matter of dispute before the Maharashtra Revenue Tribunal.

Therefore, it is clarified that the judgment of the Maharashtra Revenue Tribunal is restricted to only 91 Guntha of area from Survey No.203/9A out of 1-Hectare 32-Are and the findings recorded in the said revision application shall be restricted to the area of 91 Guntha only.

It is, therefore, made clear that the Maharashtra Revenue Tribunal's order does not extinguish petitioner's right over balance 41 Guntha.

With this clarification, the writ petition stands disposed of. No costs.
