Heard Mr. Doke, learned advocate appearing for the petitioner. He submits that, land of the Matapuri Devasthan was auctioned by Tahsildar vide publication dated 22.03.2024 by way of Eksal Lagan for the period from 2024 to 2025. The petitioner being the highest bidder was granted lease for the period of one year i.e. on Eksal Lagan basis. The petitioner found that boundaries of land are not specified, then he made correspondence with Tahsildar to carry panchanama and define the boundaries. However, his application was not decided. Being aggrieved by inaction on the part of Tahsildar, petitioner filed appeal before the S.D.O. Kalamb which was rejected holding that there is no appealable order. Although, petitioner approached District Collector and then Divisional
wp 3012.26.odt Commissioner, order has been confirmed. The petitioner raises challenge to aforesaid orders by filing present writ petition. 2.
Apparently, there is no appealable order passed by the Tahsildar. Representation of the petitioner for measurement or fixation of boundaries was not decided, but that itself would not give cause of action to file appeal under the provisions of the Maharashtra Land Revenue Code. Apparently, petitioner persuaded a wrong remedy. This Court do not find any reason to entertain present writ petition against orders impugned. 3.
At this stage, learned advocate appearing for the petitioner seeks permission to withdraw this writ petition, with liberty to take up appropriate remedy under law for redressal of his grievance.

In view of the submissions advanced, writ petition stands disposed off as withdrawn with the liberty in favour of the petitioner to take up appropriate proceedings as is permissible under law.
