Heard the learned Counsel for the Petitioner. 2.

The challenge in this Petition is to a judgment and order dated 9 May 2024, whereby the learned District Judge dismissed the appeal preferred by the Petitioner against an order of temporary injunction passed by the trial Court on 12 January 2016.

Having regard to the fact that the order of temporary injunction is in operation since 12 January 2016 and the time that has elapsed, and in view of the concurrent exercise of positive discretion by the courts below, there is no propriety in entertaining the petition at this stage. 4.

As the suit is instituted in the year 2015, the trial Court is requested to make an endeavour to hear and decide SCS No.207 of 2015 as expeditiously as possible, and, preferably, within a period of one year from the date of communication of this order.

Writ Petition stands disposed.
