This petition under Article 226 of the Constitution of India has been filed praying for the following substantive reliefs, which read thus: "(a) That this Hon'ble Court be pleased to pass an order thereby directing the Respondent No.2 to forthwith decide the Appeal No. 14 of 2023 preferred by the Petitioner before the Apex Grievance Redressal Committee, Mumbai and this Hon'ble court be further pleased to pass an order thereby staying the operation and implementation of the order dated 13th December, 2022 bearing Outward No. SRA/CEO/1335/2022;

(b) That this Hon'ble Court be pleased to call for records and proceedings of the impugned order dated 13th December, 2022 bearing Outward No. SRA/CEO/1335/2022 passed by the Respondent No.1 and after perusing the legality, validity and properties of the impugned order this Hon'ble Court be pleased to quash and set aside the same; (c) That this Hon'ble Court be pleased to pass an order thereby staying the operation and implementation of the impugned order dated 13th December, 2022 bearing Outward No. SRA/CEO/1335/2022 and

further directing the Respondents not to implement the SRA Scheme with respect to the property admeasuring 950 sq. ft. out of the property bearing City Survey No. 357, Ghorpade Peth, Pune along with the passage which is in possession of the Petitioner herein; (d) That pending the hearing and final disposal of this Petition, this Hon'ble Court be pleased to pass an order thereby staying the operation and implementation of the impugned order dated 13th December, 2022 bearing Outward No. SRA/CEO/1335/2022;

(e) That pending the hearing and final disposal of this Petition, this Hon'ble Court be pleased to pass an order thereby directing the Respondents not to implement the SRA Scheme with respect to the property admeasuring 950 sq. ft. out of the property bearing City Survey No. 357, Ghorpade Peth, Pune along with the passage which is in possession of the Petitioner herein;"

The only grievance of the Petitioner in the present appeal is that Respondent No. 2 has not decided Appeal No. 14 of 2023 preferred by the Petitioner before the Apex Grievance Redressal Committee, Mumbai, and in view thereof great prejudice is being caused to the Petitioner. The anxiety of the Petitioner is that such appeal needs to be taken to its logical conclusion and the same therefore ought to be looked into and decided in an expeditious manner and as the law would mandate.

In our view, considering the limited relief that the Petitioner seeks in the Petition, and although there being no written opposition/ reply of the Respondents, considering the nature of the orders which we propose to pass, no prejudice would be caused to the Respondents. The following order would serve the ends of justice:

ORDER

(i) Respondent No. 2 to consider and decide pending Appeal No. 14 of 2023 preferred by the Petitioner in accordance with law as expeditiously as possible, preferably within a period of 4 weeks from the date this order is made available to the said Respondent by the Petitioner. Let all parties be heard.

(ii) All rights and contention of the parties are expressly kept open.

(iii) Writ Petition is disposed of in the above terms. No Costs. (AARTI SATHE, J.) (G. S. KULKARNI, J.)
