IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 960 WRIT PETITION NO. 3336 OF 2025 SANTOSHI NAMPELLI ANDELWAR

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...

Mr. Sunil Mahadevappa Vibhute, Advocate for the Petitioner Mr. N. B. Patil, AGP for Respondent-State ....

CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.

DATED : 09/01/2026 P. C. :

1.

Heard.

2.

By this writ petition, the petitioner takes exception to the common judgment and order dated 03/03/2025 passed by the respondent / Tribe Scrutiny Committee, thereby invalidating the petitioner's tribe claim of belonging to the 'Mannervarlu' Scheduled Tribe.

3.

Learned counsel for the petitioner submits that, by the impugned common judgment and order, the tribe claims of other blood relatives of the petitioner have also been invalidated. He further submits that, out of those blood relatives, the nephew and

2 960 WP 3336-25 niece of the petitioner have challenged the same impugned judgment and order by filing Writ Petition No. 9429 of 2025 in the case of Shreyash Srinivas Andelwar and Nandini d/o Srinivas Andelwar v. The State of Maharashtra and another. He submits that this Court, after considering the genealogy tree as well as the tribe validity certificates granted by the Caste Scrutiny Committee in favour of the blood relatives of the petitioners therein, has directed to issue conditional validity in favour of those two petitioners.

4.

Learned AGP concedes the said position and does not dispute the relationship of the petitioner with the said validity holders. 5.

Considering the above, we are inclined to partly allow the writ petition. Hence, the following order.

ORDER

(i) The writ petition is partly allowed.

(ii) The impugned order dated 03/03/2025, passed by respondent No.2 / Caste Scrutiny Committee is hereby quashed and set aside.

(iii) Respondent No.2 / Caste Scrutiny Committee shall immediately issue "Mannervarlu" Scheduled Tribe

3 960 WP 3336-25 validity certificate in favour of the petitioner, which shall be subject to following conditions :

(a) The caste validity certificates shall be subject to the outcome of the re-verification of the validity certificates of their blood relatives proposed by the Scrutiny Committee.

(b) The petitioner shall not claim any equity.

(c) The petitioner shall cooperate with the Scrutiny Committee.
