We have considered the language used in Section 79 (1) of the Maharashtra Public Universities Act, 2016 (the Act of 2016). The words, "except grievances against the State Government including its officials", have been inserted prior to the connecting sentence beginning with the words, "of teachers and other employees of the university....".

As such, teachers and employees of the University, affiliated autonomous colleges and recognized institutions, other than those managed and maintained by the State Government, Central Government or a local authority, which are not within the jurisdiction of the University and College Tribunal, can approach the Grievances Committee. However, the Petitioner's case of removal from service would fall within Section 81 of the Act of 2016.

The learned Advocate for the Petitioner submits that if the Petitioner is to approach the University and College Tribunal under Section 81 of the Act of 2016, a prayer is made that the dispute be resolved expeditiously.

In view of the above, this Writ Petition is disposed off as withdrawn with liberty to approach the University and College Tribunal.

All contentions are kept open and the withdrawal of this Petition would not be an impediment.

Considering the limitation prescribed, the time spent by the Petitioner from the lodging of the Petition till the passing of this order, shall be considered as a good ground for condonation of delay.
