1.
Heard learned counsel for the parties.
2.
The challenge in this petition is to an order dated 23rd December 2024 passed by the learned Civil Judge, Senior Division, Palghar whereby till the applications for rejection of the plaint and to vacate status quo order are decided, the parties were directed to maintain the status quo. The said order has since been continued. 3.
It is the grievance of the petitioner that the application for rejection of the plaint is not being heard. The petitioner has preferred the said application, on the premises that the suit is barred under the varsha
28-wp-3463-2025.doc provisions of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest (for short, 'SARFAESI') Act, 2002. 3.
Having regard to the nature of the order, it would be expedient to request the learned Civil Judge seized with Suit No. 22 of 2024 to hear and decide the application for rejection of the plaint and other interim applications as expeditiously as possible. 4.
The parties shall co-operate with the Court in the hearing and disposal of the application and shall not seek any adjournment. 5.
Petition disposed.
