Learned counsel Mr.Bodake opposed the prayers. 3.
The Petitioner made an Application to the Aadai Grampanchayat, Panvel for grant of permission to construct a new house. On the basis that the Application was not responded, it is the contention of the Petitioner that there is deemed permission to construct the house and hence, the Petitioner proceeded to construct the house. It is, therefore, the submission of learned counsel for the Petitioners that new house number has to be granted / allotted by the Grampanchayat and accordingly, house tax has to be charged in the name of the Petitioners. Our attention is invited to Page No.147 which is the response dated 20th April 2022 of the Grampanchayat. The Petitioner was asked to appear before the Grampanchayat on 27th April 2022 at 11.00 a.m. along with the necessary proofs of revenue extracts in support of the Application that was made.
4.
It is the contention of learned counsel for the Petitioners that no orders have been passed on the Application made to the Grampanchayat for levy of charge of house tax i.e. Gharpatti in the name of the Petitioners. In such view of the matter, the Grampanchayat is directed to take appropriate decision on the request made by the Petitioners as reflected in prayer clause (a) of the Petition, as early as 2/3
possible and in any case, within a period of four weeks from the date of communication of this order. It is open for the Petitioners to produce documents in support of the Petitioners' case along with copy of this order.
5.
Writ Petition is disposed of accordingly.
