An arguable question, as to whether the trial court could have rejected the application for amendment in the written statement, when defendant No.3 has filed the written statement, upon being impleaded in the suit, raising contentions which cause prejudice to defendant Nos.1 and 2, arises for consideration.

Issue notice to the respondents, for final disposal, returnable on 24th June, 2025.

In addition to notice through Court, the petitioners are at liberty to serve the respondents by private service and file an affidavit of service.
