The present Writ Petition takes exception to order dated 27.02.2025 passed by Sub Divisional Officer, Ahilyanagar on application for stay in RTS Revision Application No.4/2025. 2.

On 27.03.2025, this Court issued notice to respondents and granted interim relief in terms of prayer Clause (C) i.e. stay to execution, operation and implementation of judgment and order dated 24.12.2024 passed by respondent no.12/Tahsildar, Newasa in Rasta Case No.20/2024.

Till this date, RTS Revision Application No.4/205 is pending for decision before Sub Divisional Officer, who is Competent Authority under Section 23 of Mamlatdar's Courts Act to decide Revision against order passed by Mamlatdar. Since present Writ Petition emanates from interim order passed on stay application, it would be in interest of both parties that Revision Application pending before the Sub Divisional Officer is decided expeditiously, so that controversy is brought to an early conclusion. In that view of mater, Writ Petition can be disposed of by following order:

ORDER

a.

The Sub Divisional Officer shall decide RTS Revision Application No.4/2025 within period of eight weeks from date of this order.

b.

Till final decision in RTS Revision Application No.4/2025, interim relief granted by this Court vide order dated 27.03.2025 shall remain in force.

c.

In view of disposal of Writ Petition, pending Civil Application also stands disposed of.
