The principal grievance raised by the petitioner is that the appellate authority is not available for hearing. However, learned Additional Government Pleader for the State, on instructions, has produced on record copy of notice indicating that appeal under Section 35 of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act 1971 has been fixed by the appellate authority on 3 April 2025.

In view of date of hearing being fixed by the appellate authority, the writ petition need not be entertained. However, all questions raised by the petitioner in the writ petition are kept open to be agitated before the appellate authority. 3.

The writ petition stands disposed of. No costs. 4.
