The challenge in this Petition is to an order dated 27th November, 2025, passed by the Maintenance Tribunal, Mumbai, under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 ("Senior Citizens Act"). In view of the Division Bench Judgment of this Court in Jagdish Pitambar Pawar Vs. Pitambar Pundalik Pawar and ors.1 , an Appeal against an order passed by the Maintenance Tribunal is maintainable even at the instance of the child or relative, under Section 16 of the Senior Citizens Act. 3.

The Petition stands disposed with liberty to the Petitioner to file an Appeal before the Appellate Tribunal. Writ Petition No.36 of 2023, High Court of Bombay bench at Aurangabad dated 29.11.2023. Vina Khadpe

In the event such an Appeal is filed within a period of two weeks from the date of uploading of this order, the Appellate Tribunal is requested to hear and decide the Appeal as expeditiously as possible. In case, the question of limitation arises, the Appellate Tribunal shall have due regard to the fact that the Petitioner had preferred the Petition before this Court, and the time spent in prosecuting this Petition will be accounted for under section 14 of the Limitation Act.
