We have heard Mr. Godbole, the learned Senior Advocate for the Petitioners, Mr. Abhijit Kulkarni, the learned Advocate for the Respondent Municipal Corporation, Pune and Ms. Tanu Bhatia, the learned AGP.

After a brief hearing in the matter, Mr. Godbole, the learned Senior Advocate submits that a representation dated 11.11.2024 that has been addressed to the Municipal Corporation, will have to be considered

in the light of the decision of the Corporation dated 17.8.2022, vide which, a stop work notice issued to a different developer namely, M/s. Manavi Developers, has been withdrawn. He submits that, akin to the notice of stop work notice dated 20.6.2022 issued to the Petitioner, Manavi Developers was also issued with a similar stop work notice. The said developer approached the Corporation and offered an explanation. After considering the explanation, the stop work notice issued by the City Engineer was withdrawn. He, therefore, submits that his representation may be considered in the light of the decision dated 14.7.2022 taken by the Municipal Corporation in favour of M/s. Manavi Developers.

Mr. Godbole, further submits that written submissions in support of the representation dated 11.11.2024, would be tendered to the Municipal Corporation within 7 days from today. 4.

We, therefore, would grant further 45 days for the Corporation to consider the representation and the written submissions and pass a reasoned order. All contentions are kept open. 5.

In view of the above, this Petition is disposed off.

Needless to state, if the Petitioners are aggrieved by any decision of the Corporation, they would be at liberty to avail of a remedy as is permissible in law.
