Heard, Ms. Darawala learned Counsel appearing for the Petitioner and Mr. Deepak Pant who appears in person.

By the present Writ Petition filed under Article 227 of Constitution of India, the Petitioner is challenging the legality and validity of the order dated 9th December, 2024 passed by the learned Judge, Family Court No. 2, Mumbai below Exhibit '161' in Petition No. A-1790 of 2016. By the impugned order the said application has been rejected.

The prayer in the said application bearing Exhibit '161' is seeking direction to the Respondent to provide legible copies of the documents submitted by the Respondent alongwith the counter claim.

Learned Judge of the Family Court has observed that the counter claim was filed on 31st August, 2019. Thereafter, issues were framed in the year 2022 and the said application bearing Exhibit '161' is filed on 3rd August, 2023 i.e. after about four years after the counter claim is filed. It is further observed that there is no explanation given for the said four years delay.

Before the learned Family Court, the Respondent has submitted that the application is filed as a delay tactics. 6.
In any case, no case is made out for interference in the impugned order in the Writ Jurisdiction of this Court under Article 227 of the Constitution of India.

Accordingly, Writ Petition is dismissed, however, with no order as to costs.
