The present proceedings are listed before us on the backdrop of the earlier order passed by this Court on 18th June 2025, by which the present petition was disposed of by recording the stand of the Municipal Corporation that the illegal building in question would be demolished. On 2nd July 2025, when the proceedings were listed before us for compliance, substantial progress, which was made in that regard was noted by the court and the proceedings were accordingly adjourned recording a statement as made on behalf of the Municipal Corporation that the entire demolition would be undertaken by today.

Mr. Reddy, learned counsel for the Thane Municipal Corporation has placed on record a communication received by him from Mr. Shivprasad Meera Jadhav

2/2 2-wp-4210-25.doc Nagargoje, Assistant Commissioner and OSD, Diva Division of the Thane Municipal Corporation, dated 15th July 2025 that the building in question as described in the said communication, which is stated to be the suit building, has been completely demolished and that the expenditure which was incurred by the Thane Municipal Corporation for demolition of this building and for removal of the debris would now be recovered from the concerned developers. The photographs which are annexed to the said communication also indicates that on 14th July 2025 at 6.00p.m. the entire construction has been demolished. We accept the statement of Mr. Reddy based on such communication as received by him that the building has now been completely demolished. We also take the said communication and photographs on record which are marked as X and X-1 respectively, for identification. Thus recording the compliance, the proceedings are removed from the board.

We appreciate the steps taken by the Commissioner of the Thane Municipal Corporation in taking appropriate action on such illegal constructions.

Copy of this order be forwarded to the Municipal Commissioner, Thane Municipal Corporation by Mr. Reddy.
