A limited prayer in this petition is to decide the Miscellaneous Civil Appeal No. 289 of 2023, preferred by the petitioner, being aggrieved by the order dated 17th August 2023, whereby the application preferred by the petitioner for temporary injunction came to be rejected by the Trial Court. 3.

Mr. Godbole learned Senior advocate for the respondent submits that in view of certain developments, the respondents have preferred an application for transfer of the Miscellaneous Civil Appeal to another Court and said application is subjudice before the learned varsha

Mr. Vagyani, learned counsel for the petitioner, submits that according to his instructions, the said application for transfer is now listed on 15th April 2025.

Without delving into the correctness of the grievances regarding the delay in disposal of Miscellaneous Civil Appeal, as the said appeal has been preferred against an order rejecting the application for temporary injunction it may be expedient to direct that the said Miscellaneous Civil Appeal is heard and decided expeditiously. 6.

In the meanwhile, the learned Principle District Judge, Pune is requested to hear and decide the said application for transfer of Miscellaneous Civil Appeal No. 289 of 2023 as expeditiously as possible.

The petition, thus, stands disposed with a request to the learned District Judge who is entrusted with Miscellaneous Civil Appeal No. 289 of 2023 to hear and decide the said appeal as expeditiously as possible and preferably within a period of three months from the date of the decision in the transfer application.
