In this writ petition, the petitioner has assailed the validity of the order dated 28th March, 2025 by which technical bid of the petitioner in respect of the tenders issued for operation and maintenance of the pumping station situate at various places within the Pimpri Chinchwad Municipal Corporation has been rejected.

Learned counsel for the petitioner submits that even though the petitioner had submitted the documents with regard to completion of work in respect of similar work and qualifies criteria laid down in the tender notice, yet the technical bid of the petitioner has been rejected on erroneous assumption that the petitioner does not fulfill the eligibility criteria.

Issue notice to the respondents.

Mr. Ganbavale, learned counsel, appears for respondent nos.1 and 2 and waives service of notice and points out that five technical bids of the petitioner for five different tenders have been rejected, however, the petitioner has chosen to challenge the same only in one petition and the petitioner will have to confine its relief to rejection of technical bid in respect of one tender only as it cannot be granted relief in respect of rejection of technical bid in multiple tenders. However, he prays for and is granted two weeks' time to enable him to file affidavit-in-reply.

The aforesaid issue with regard to seeking multiple reliefs in respect of rejection of technical bid in multiple tenders in one petition is kept open.

It is provided that any action taken shall be subject to outcome of the writ petition.
