This petition takes exception to the order dated 01.06.2024 passed by the Family Court, Pune, below Exh. 5 in Petition No. C-5 of 2022.

The respondent-wife has filed the petition for divorce against the petitioner-husband. In the said petition, by the order impugned, the learned Family Court has allowed the application filed by the respondent under Section 24 of the Hindu Marriage Act and directed the present petitioner to pay maintenance at the rate of Rs.15,000/- per month to the respondent for their minor son.

I have heard the learned counsel for the parties and perused the impugned order.

The learned counsel for the petitioner submits that the respondent is working as a Warden and getting salary of Rs. 33,000/- per month. It is submitted that the respondent has not filed the affidavit of assets and liabilities. 5.

It is not in dispute that the petitioner is working as a Teacher and getting salary of Rs.82,518/-. No challenge is raised to the quantum of maintenance granted by the Family Court. I am therefore, not inclined to interfere with the impugned order on the ground of not filing the affidavit of assets and liabilities by the respondent as it is not the case of the petitioner that he is under no obligation to provide maintenance to the son. The Petition is dismissed.
