This is yet one more case of Respondent No.1 not discharging his duties diligently. A proposal dated 14th May, 2024 is not decided even till today, after a passage of 13 months. We find that there are numerous Petitions everyday on our board wherein we are only required to direct various officers of the Education Department to discharge their duties diligently. Since proposals are kept pending, such Petitions are being filed. 2.

We could have initiated action under Section 10 of the Maharashtra Government Servants Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act, 2005. The

learned AGP prays that such order may not be passed. Hence, we are imposing costs of Rs.10,000/- on Respondent No.1, which shall be deposited by him from his salary bank account in this Court, within 21 days from today. Since the Petitioner consents, the said amount shall be donated to the following two establishments :

(1) Children Aid Society, Mumbai Account No.: 02370100005612 Bank Name : UCO BANK Branch : Matunga IFSC : UCBA0000237

(2) National Association for the Blind Account No. : 3740000100008551 Bank : Punjab National Bank Branch : Worli Seaface IFSC Code : PUNB0374000 The Registry is directed to transfer the said amount, accordingly.

Respondent No.1, the then Deputy Director of Education, Pune, shall decide the pending proposal by following the due procedure laid down in law within a period of 60 days from today. The said proposal shall be decided on its own merits,

notwithstanding whether the Management has inducted any new person in place of the Petitioner.
