It is the case of the petitioner that he is the owner of a land admeasuring 0.31 R from Survey No.1/4B+5 situated at Village Pendhar, Taluka Panvel, District Raigad. As per the Revenue Records, this land is shown to have been included in an award passed on 7th September 2006. 3.

The learned counsel for the Petitioner submits that this entry has been incorrectly taken and the subject land was not part of the acquired land. The Deputy Collector on 19th January 2013 has furnished such information to the petitioner. The petitioner therefore seeks deletion of the reference to the acquisition of the aforesaid land from other rights column. 1/2 11-WP-4869-2025.doc Dixit

It appears that the petitioner has not yet approached the Tahsildar for having the Revenue Records corrected.

In these facts, the interest of justice would be served by permitting the Petitioner to move an application seeking correction of the Revenue Records before the Respondent no.4-Special Land Acquisition Officer, Respondent no.6-The Sub-Divisional Officer and Respondent no.7-The Tahsildar. If such application is made, the same shall be considered on its own merits and in accordance with law. The petitioner is at liberty to furnish additional documents along with his application to substantiate his contention. The decision taken by the Tahsildar shall be communicated to the petitioner.
