CORAM : A.S. CHANDURKAR & DR. NEELA GOKHALE, JJ DATE : 9th MAY 2025.

P.C. :

1.

By an earlier order dated 13/03/2025 passed in Writ Petition No. 10871 of 2024 (Sanjeevani Shikshan Prasarak Mandal & Anr. Vs. The State of Maharashtra), the petitioners therein were permitted to take steps for filling vacancies at the school run by the Public Trust which exercise was made without prejudice to the rights and contentions of the parties in view of their inter-se disputes with regard to the affairs of the Public Trust. 2.

Review Petition No.75 of 2025 has been filed by applicants who were not parties to the aforesaid proceedings and they seek review of this order. The petitioners who have preferred Writ 1/2

Rameshwar Dilwale 912-WP-4975 WITH RPW-75-25.doc Petition No.4975 of 2025 seek steps to be taken to implement the order dated 13/03/2025 passed in the earlier writ petition. 3.

Today, the learned counsel for the review applicants as well as the petitioners in Writ Petition No.4975 of 2025 have tendered Minutes of Order whereby the parties have agreed to constitute a three member Committee headed by the Education Officer (Secondary) as its Head so as to take steps to complete the recruitment process as per the procedure prescribed. We have perused the same and we are satisfied that accepting the Minutes of the Order would resolve the dispute between the parties. 4.

Accordingly, the Minutes of the Order are taken on record and marked 'A' for identification. The Writ Petition and the Review Petition are disposed of in terms of the said Minutes of Order. Suffice it to observe that the Education Officer (Secondary) would have the final say in the matter and he would take his decision through majority of the Committee members. In view of aforesaid, the Education Officer (Secondary) shall permit opening of the Pavitra Portal to undertake the exercise of recruitment. 5.

Parties to act on authenticated copy of this order. [ DR. NEELA GOKHALE, J. ] [ A.S. CHANDURKAR, J. ] 2/2
