The learned AGP submits that the pending proposal dated 12th April, 2019 would be decided within 45 days. He further submits that the earlier Education Officer (Secondary), Zilla Parishad Thane, has been transferred and it is six years that the proposal is pending.

In view of the above, this Writ Petition is disposed off with a direction to Respondent No.3, to decide the pending proposal dated 12th April, 2019 strictly in accordance with Rule 41 of the Maharashtra Employees of Private Schools (Conditions of Service) Nikita

40-wp-5130-2025.odt Rules, 1981 by following the due procedure laid down in law, within a period of 45 days.

A meticulous scrutiny shall be carried out under Rule 41 and a reasoned order shall be passed.

In the event, the approval is refused, the aggrieved party is at liberty to avail of a remedy as is permissible in law. If the approval is granted, further steps for grant of Shalarth I.D. shall be expeditiously undertaken. We make it clear that we have not expressed any opinion as regards the merits of the proposal.
