Unfortunately, this is the third round of litigation wherein the petitioner has been constrained to approach this Court seeking expeditious disposal of his tribe claim.

Previously, by order dated 01/04/2026 in Writ Petition No.3699 of 2016 and thereafter again vide order dated 31/07/2019 passed in Writ Petition No. 9434 of 2019, this Court had directed the respondent/Scrutiny Committee to decide the petitioner's tribe claim expeditiously. It appears that no effective steps have been taken since then, which has compelled the petitioner to approach this Court once again.

We find that the respondent/Scrutiny Committee is not diligent in deciding the petitioner's tribe claim, which has been pending since 28/11/2017. As a last indulgence, we direct the respondent/Scrutiny Committee to decide the petitioner's tribe claim pertaining to 'Koli Mahadev' Scheduled Tribe, pending since 28/11/2017, as expeditiously as possible and in any case within a period of three months from today.

We make it clear that if the respondent/Scrutiny Committee fails to decide the petitioner's tribe claim within the stipulated period, the same shall be viewed seriously and will be treated as an aggravated contempt against the members of the respondent/ Scrutiny Committee.
