By this writ petition, the petitioner is seeking direction that the caste claim of the petitioner pending with respondent No.1/Caste Scrutiny Committee since 10.10.2024, be directed to be decided expeditiously.

Learned counsel for the petitioner submits that since the caste claim of the petitioner is pending, respondent Nos.3 and 4/employer have issued notice on 06.03.2025 calling upon the petitioner to submit caste validity certificate, failing which service of the petitioner would come to an end. In that view of the matter, we are inclined to direct respondent No.1 to decide the caste claim of the petitioner within a period of six months

(2) 1033 WP-5238.2025.odt from today. Till the caste claim of the petitioner is decided, the respondents/employer shall not take any coercive action against the petitioner.

Learned counsel for the petitioner submits that though the petitioner is rendering service, respondent Nos. 3 and 4 are not paying regular salary to the petitioner. We are of the view that merely because claim of the petitioner is pending and since she is rendering service, she cannot be deprived from the payment of salary.

We, therefore, direct respondent Nos.2 to 4 to pay regular salary to the petitioner and continue to pay the same subject to decision of her caste claim.

With the aforesaid direction, writ petition stands disposed of.
