The petitioner, who has completed first year B.Ed. course from respondent no.2 college, is stuck up and is not able to appear for the second year examination which she has not been allowed only on the ground that she does not possess a certificate of validity of her caste. 2.

We have heard the learned advocate for the petitioner, learned AGP for respondent nos. 1 and 4 and learned advocate Mr. V. P. Golewar holding for Mr. A. R. Joshi who appears suo mutu for respondent no.3/the Director, Board of Examination and Evaluations, Savitribai Phule University, Pune.

If the petitioner's claim remains undecided for whatever reason and the committee is unable to decide it, she cannot be made to suffer.

1011wp5256-25 Already she was allowed to appear for the examination of first year of B.Ed. course. Now, she seeks to appear for the final examination which is to commence from 28 April 2025.

In this peculiar circumstance, we dispose of the writ petition directing respondent no.3 to permit the petitioner to appear at the final year examination of the B.Ed. course through respondent no.2 college and shall ensure that in coordination with petitioner and college, requisite examination form is tendered.

Performance of the petitioner shall not be declared without the permission of the court.

Respondent no.4 scrutiny committee shall expedite the petitioner's claim for validation of the tribe certificate and in any case, shall decide it finally within four weeks.

The order is dictated in the open court and it would be responsibility of learned advocates for the respective parties to see that it is being implemented in letter and spirit.
