Heard the learned advocate for the petitioner as also the learned AGP.

The petitioner who intends to participate in the public hearing touching the environment impact assessment report is seeking that the hearing is postponed. Learned AGP would oppose the request by pointing out that the summery of environment impact assessment report as is mandated by notification dated 14 September 2006 (Exh.F) has already been served to the petitioner in Marathi which is the local language and no adjournment is contemplated, except for the reason as indicated in clause 3.3.

In the light of above, the learned advocate for the petitioner, on

975wp5443-25 instructions, submits that the petitioner would be satisfied, if the District Magistrate is merely called upon to consider his representation dated 21 April 2025 (Exhibit D). The request is innocuous. 4.

Without expressing anything on the merit of the request being made by the petitioner, writ petition is disposed of directing respondent no.3 to consider the petitioner's application/grievance (Exhibit D) on its own merit and to take appropriate decision in accordance with law.
