The Petitioners are aggrieved by the fact that their proceedings filed under the provisions of the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947 (herein after "Act of 1947"), before Respondent No.3 are stuck up for want of joint measurement.

Learned Advocate for the Petitioners has placed on record copy of notice dated 9th October, 2024, calling upon the concerned to appear before the Tahsildar, Purna, along with relevant documents, on 9th October, 2024. Though the concerned parties appeared before the Tahsildar, Purna, no further steps for
{2} wp5482-25.doc joint measurement are taken by the Respondents. Hence, this Petition.

Considering the limited grievance made by the Petitioners and as the Petitioners have only pressed prayer clause "B", for the present, the Writ Petition is disposed of by directing Respondents No.4 and 5 to carry out the joint measurement of survey Nos. 17 and 14 of village Purna, District - Parbhani, within a period of 8 weeks from the date of receipt of copy of this order, by giving notice to all the concerned. 4.
After the joint measurement is carried out, the proceedings bearing No. 519 of 2024 filed by the Petitioners under section 32 of the Act of 1947, be decided, after giving opportunity of hearing to all the concerned, within a period of 8 weeks from the date of receipt of report of the joint measurement.
