The petitioners, which runs a school for differently abled, are aggrieved by the fact that by the impugned communication the Executive Engineer (PWD) has refused to fix the rent of school building as was requested by the petitioner, for the years 2003 to 2020. 2.

We have heard both the sides. The impugned communication refuses to consider the request of the petitioner on the ground that the rent would be dependent upon the physical condition of the building. No other reason is quoted for inability of the respondent-Executive Engineer to determine the rent.

The learned advocate for the petitioners submits that the petitioners would try to convince the respondent-Executive Engineer by producing the structural audit reports of the building from time to time and would endeavour to satisfy him to apply his mind to all the parameters enabling him to determine the rent, if it is so possible. 1/2

We dispose of the writ petition with liberty to the petitioners to approach the Executive Engineer concerned who shall permit them to produce the documents for his satisfaction to enable him to determine the rent of the building from the year 2003 to 2020. It is clarified that we have not expressed anything on merit.
