The petitioners, who claim to be the Trustees, are taking exception to the steps being taken by the respondents for undertaking a recruitment process pursuant to an advertisement, which is sought to be injuncted. 3.

We have heard the learned advocate for the petitioners. 4.

On a query, the learned advocate informs us that respondent nos. 3 and 4 are the strangers, and not even members of the Trust and still are going ahead with the recruitment process. The issue regarding change report has been pending before the authorities and even before a learned Single Judge of this Court. The petitioners are even protected. The Deputy Charity Commissioner has been injuncted from passing final order in a change report enquiry.

Considering the aforementioned factual dispute, keeping open the remedy to the petitioners to approach the authorities under the Maharashtra Public Trust Act by filing appropriate proceeding either under Section 41A, or 41E or as may be deemed necessary, the writ petition is disposed of.
