BENCH AT AURANGABAD 983 WRIT PETITION NO. 5653 OF 2025 MADHAV PUNDLIK KALE

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...

Advocate for the Petitioner : Mr. Kudle Dhanaji Shrikantrao AGP for Respondents: Mr. R.K. Ingole ...

CORAM

: MANGESH S. PATIL & Y. G. KHOBRAGADE, JJ.

DATE : 29.04.2025 PER COURT :

Heard.

2.

The petitioner is aggrieved by the fact that steps being taken at the instance of some one pursuant to an application stated to be unsigned for effecting mutation in a proceeding under Section 150(2) of the Maharashtra Land Revenue Code, 1966. The petitioner is aggrieved by the fact that he has already lodged an objection with the concerned Talathi on 18.01.2025 showing his interest in the property.

3.

In our considered view, till the time the mutation is not effected by appropriate certification, the petition is premature. It is pertinent to note that already a note of his complaint has been taken in the statutory register maintained in Form 6A maintained under the Rules framed under the Maharashtra Land Revenue Record of Rights and Registers (Preparation and Maintenance) Rules, 1971(Exh. G).

4.

The writ petition is disposed of keeping open the liberty to the petitioner to resort to the appropriate remedy if and when there is actual cause of action in the form of certification of the mutation. ( Y. G. KHOBRAGADE, J.) (MANGESH S. PATIL, J.) mkd/- 1/1
