IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.5690 OF 2025 Harichandra Barku Chaudhari ....Petitioner

Versus

The Additional Commissioner Adivasi Vikas (Nashik Division) & Ors.

....Respondents ---- Mr. Saurabh Pakale a/w. Mr. Nilesh Desai i/b. Mrs. Padmaja Malgaonkar for the Petitioner.

Mr. V.G. Badgujar, AGP for the Respondent - State. ---- CORAM : RAVINDRA V. GHUGE & ASHWIN D. BHOBE, JJ.

DATE : 6th OCTOBER, 2025 P.C. :- 1.

The Petitioner's name is involved in the 2018 TET Exam Result Scam. He desires that his name should be re-included in the Sevarth Pranali Portal when his performance in the TET has been cancelled and, therefore, the TET passing certificate is inconsequential. Now he has passed the CTET and prays that his proposal for grant of approval on the basis of the CTET result from the date he passed the exam, may be considered by the Authorities. 2.

In view of the above, the Management, which has appointed the Petitioner, is at liberty to prepare a fresh proposal by including the CTET qualification and tender the same to the Gauri Gaekwad

47.WP-5690-2025.odt competent Authority for grant of approval. In our view, the said proposal can be considered independently on the basis of the CTET qualification from the date he has acquired the qualification. It is a different issue altogether that if, subsequently, the Petitioner gets punished for his purported involvement in the 2018 TET Exam Result Scam, the Education Department and the Employer would be at liberty to initiate appropriate action in a manner as is permissible in law.

3.

Therefore, we direct that the fresh proposal, if filed within 15 days, be considered and decided on or before 30th November, 2025.

4.

With the above directions, this Petition is disposed off. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.) Gauri Gaekwad
