CORAM:

M.S. Sonak & Advait M. Sethna, JJ.

DATED:

09 September 2025 PC:- 1.

Learned Counsel for the Petitioner states that the Respondents have been duly served. There was an appearance filed by Ms Kavita Shukla and the learned Counsel for the Petitioner states that even she has been served. 2.

The learned Counsel for the Petitioner points out that in this case, the Petitioner has been classified as a risky exporter and his entitlement to Drawback and RoSCTL has been suspended. He says that all this visits the Petitioner with serious civil consequences but still, there was not even a AMOL PREMNATH JADHAV minimum compliance with principles of natural justice as it AMOL PREMNATH JADHAV Date: 2025.09.10 20:30:09 +0530 contemplated with under Section 8 of the Foreign Trade (Regulation and Development) Act, 1992. Accordingly, he presses for ad-interim relief.

77-WP-5692-2025.DOCX 3.

Before we consider the Petitioner's prayer for ad-interim relief, we think it would be appropriate to hear the Respondents, now that the Respondents have appeared through an Advocate. Affidavit in reply is on record though, the learned Counsel for the Petitioner states that no copy has been served upon him.

4.

Accordingly, we post this matter on the 17 September 2025 for directions. We clarify that if the Respondents or their Advocates are not present, we will have to proceed in the matter in their absence.
