CORAM : H.M. BHOSALE REGISTRAR (JUDL-I) Date : 25/04/2025 The aforesaid writ petition was notified on 08th/09th April 2025 for removal of office objections as provided under Rule 3 sub rule (ii) of the Chapter XVII of the Bombay High Court Appellate Side Rules, 1960 (for short 'Rules 1960').
The learned Advocate and the Petitioner/s have failed to remove office objections. Therefore, by virtue of Rule 3 sub rule (iii) of Chapter XVII of the Rules 1960, the aforesaid Writ Petition is listed on the board of Registrar (Judicial-I).
Sub-rule (iii) of Rule 3 of Chapter XVII provides that if office objections are not removed, after notifying the same under Rule 3 sub rule (ii), the Registrar shall refuse registration of the matters.
However, it would not be proper to straightway refuse the registration. It would be just and proper to give one more opportunity to the Petitioner/s and their Advocate to remove office objections.
In turn, two weeks time is granted to the Petitioners and the learned Advocate to remove office objections. On failure, appropriate order as contemplated under Rule 3 sub rule (iii) of Chapter XVII of the Bombay High Court Appellate Side Rules, 1960 will be passed.
