After this petition was heard for some time, Mr. Madon, learned senior counsel for the petitioner, on instructions of Mr. Karan Mann, authorized representative who is present in the Court, seeks leave to withdraw this petition with liberty to the petitioner to approach the Civil Court in the proceedings of R.C.S. No. 455 of 2021 pending before the Court of 6th Joint Civil Judge, Junior Division at Baramati. We are also informed that there was 28 April 2025 Kiran Kawre

502-WP-5752-2025.DOC an interim injunction application which was granted by the Civil Court vide order dated 8 September 2022 which is stated to be in operation. 3.

Be that as it may, in our opinion, it is appropriate for the petitioner to move the Civil Court in the pending proceedings and assert all its contentions including on the rights which would accrue to the petitioner including under the order of interim injunction, if the same was valid and subsisting. We accordingly do not intend to delve on the merits of the rival contention.

All contentions of the parties are expressly kept open. 5.

Allowed to be withdrawn with liberty as prayed for. 6.

In the event, an application is made by the petitioner seeking further interim reliefs, the same be considered by the Civil Court expeditiously, on the prayers for ad-interim reliefs.

Disposed of. No costs.
