When we point out that there is nothing on the record to indicate that the petitioner is being not treated as governed by the Maharashtra Civil Services (Pension) Rules, 1982 and is being treated under the Defined Contributory Pension Scheme (DCPS), in the light of the fact that nothing has ever been deducted from his salary for last 20 years as his contribution towards the scheme under DCPS, and on the contrary, deductions are being made towards the provident fund account, the learned advocate for the petitioner, on instructions, seeks leave to withdraw the writ petition and resort to an appropriate remedy at an appropriate stage, if and when the actual cause arises.

The petition is disposed of as withdrawn with liberty as prayed for.
