P.C.:- 1) Heard learned Counsel for the Petitioner.
2) The Petitioner seeks a direction against the Respondent Nos.1 & 2 - Corporation to implement and execute the notice dated 22nd April, 2022 and thereby pull down the unauthorized construction in a time bound manner.
3) Mr. Patil, learned Counsel for the Respondent Nos.3 to 11 submits that some portion of the structure has been voluntarily undertaken to be pulled down. So far as rest of the structure for which no authorization was obtained, the Respondent Nos.3 to 11 to file an appropriate Application 1/2
Manoj 24-WP-5879-2025.doc with the Corporation for retention under Section 53 of the Maharashtra Regional and Town Planning Act, 1966, within a period of four weeks from today. If such an Application is made, the Respondent Nos.1 and 2 - Corporation to decide the Application for retention within a period of eight therefrom. If there are any deficiency, the Corporation shall give sufficient notice to the Respondent Nos.3 to 11 to rectify the deficiency. 4) In case it is found that the structure is unauthorized, the Corporation has to proceed with against the said structure by taking action within a period of eight weeks from the date the adverse Orders are passed against the Respondent Nos.3 to 11.
5) Petition is disposed of.
