This is a writ petition challenging orders dated 09th January 2025 and 27th January 2025, passed by a learned Arbitrator, whereby the Arbitrator has repudiated a challenge raised to his capacity to continue as an Arbitrator. 3.

It is a settled position of law from the judgment of the Supreme Court in the case of SBP & Co., Vs. Patel Engineering Ltd.1 onwards that in such matters, writ petition is not maintainable. 4.

The petitioner can exhaust the remedies provided under the Arbitration and Conciliation Act, 1996.

In view of the above, the writ petition is dismissed as not maintainable. Needless to say, the petitioner would be at liberty to exhaust such remedies as available under the Arbitration and Conciliation Act, 1996. (MANISH PITALE, J.) (2005) 8 SCC 618 Shrikant Malani
