Mr Pathak, learned counsel for the Petitioner, on instructions, submits that this Petition could be disposed of by directing the Deputy Commissioner of Customs (Respondent No.2), to dispose of the Petitioner's representation dated 03 March 2025 (page Nos.158 to 166 of the paper book), expeditiously. On further instructions he submits that without prejudice to the Petitioner's contention that the proposed intervenor M/s. Rampuria Exports Pvt. Ltd. have no locus standi in this matter, even proposed intervenor could be heard by the Deputy Commissioner of Customs at the stage of disposal of this representation.

Accordingly, we direct the Deputy Commissioner of Customs (Respondent No.2) to dispose of Petitioner's representation dated 03 March 2025 after hearing representatives of the Petitioner and M/s. Rampuria Exports Pvt. Ltd., in accordance with law and on its own merits, within one month from the date of uploading of this order. The said decision should be communicated to both the parties within this period of one month.

All contentions of all parties are left open. The Petition is disposed of in above terms without any orders as to costs. 5.

In view of disposal of this Petition, the Interim Application does not survive and is also disposed of. 6.

All concerned must act on an authenticated copy of this order.
