Heard Mr. Inamdar, learned counsel for the petitioner. 2.

In this case, the petitioner society is challenging order dated 02.01.2025 passed by the Maharashtra State Co-operative Appellate Court, whereby appeal filed by the petitioner was dismissed and order passed by the Co-operative Court dismissing the dispute instituted by the petitioner society was confirmed.

It is brought to the notice of this Court that the principal ground for holding against the petitioner society was that, it had already adjusted gratuity amount payable to the respondent towards its claim of advance amount being paid to the respondent.

It is brought to the notice of this Court that in a separate proceeding initiated by the respondent, by an order dated 09.11.2021, the Industrial Court at Solapur directed the petitioner to pay gratuity to the respondent along with 10% interest. The same is challenged by the petitioner society by filing Writ Petition No.10070 of 2022 and the same MINAL SANDIP PARAB MINAL SANDIP PARAB Date: 2025.06.11 11:10:34 +0530 is pending. This Court finds substance in the contention raised on behalf 1/2

12_WP6104_25.doc of the petitioner society that, in the event the said writ petition is dismissed by this Court, the petitioner society would be required to pursue the present writ petition in order to demonstrate why the Maharashtra State Co-operative Appellate Court ought not to have dismissed the dispute raised by the petitioner society. 5.
