While addressing the Court, the learned Advocate for the Petitioner points out that his Principal Employer is not a party to this Petition. He has preferred a Writ Petition (C) No. 3011 of 2025 against the Principal Employer before the Delhi High Court praying for a direction to the Employer to issue the vigilance clearance in his favour. That Petition is pending. Now, a vacancy is declared by Respondent No.2 for the post of Director (Finance). It is conceded that Respondent No.2 is not the Employer of the Petitioner. It is clarified that the vigilance clearance certificate, which is prayed for before the Delhi High Court, is for the same post which is declared vacant by Respondent No.2. Trupti

In view of the above, we find that the Petitioner should be restrained from indulging in forum shopping. If a prayer for a vigilance clearance certificate is pending before the Delhi High Court in a Writ Petition and if that certificate may enable the Petitioner to apply for the post of Director (Finance), if legally permissible, the Petitioner should approach the same Court in the pending Writ Petition. 3.
