On the last occasion, a co-ordinate Bench of this Court of which one of us (G. S. Kulkarni, J.) was a member, had passed an order recording that the hearing on the Show Cause Notice was already concluded and the order was expected to be passed. Today, we are informed by Dr. Poddar, learned counsel for the petitioner, that the order is already passed. 2.

In this view of the matter, we are of the opinion that it would be appropriate for the petitioner to file fresh proceedings, as may be permissible in law. Dr. Poddar informs that such proceedings would be filed within a period of 10 days from today, hence a protection be granted for such period. 3.

We accept the request. For the period of ten days from today, no coercive action shall be taken against the petitioner on the basis of the impugned order. 9 April 2026

3-WP 6499-25.DOC Such protection is no expression on the merits of the rival contentions of the parties and only to enable the petitioner to pursue the remedy as available in law. 4.
