The Petitioner has been appointed on 17th March, 2025 as a Shikshan Sevak, without having the qualification of Teacher Eligibility Test (TET) / Central Teacher Eligibility Test (CTET)/ Graduate + B.Ed. Her proposal for approval has been rejected by the impugned order dated 24th April, 2025.

We have considered the situation of candidates passing the TET/CTET examination after the cut off date 31st March, 2019, in the judgment delivered by this Court, at the Aurangabad Bench, dated 7th September, 2023 in Writ Petition No. 11121 of 2023 (Dattatry Devidas Sonwale And Another V/s. The State of Maharashtra Through Its Principal Secretary And Others).

In view of the above, this Writ Petition is disposed off keeping in view that the learned Advocate for the Petitioner makes a statement, on instructions, that the Petitioner would be appearing for the TET in the immediate approaching examination schedule. After the Petitioner passes the TET exam and subject to the view taken by this Court in Dattatry Devidas Sonwale (supra), we grant liberty to the Management to tender a fresh proposal seeking approval to the appointment of the Petitioner after she clears the TET/CTET.

If such a proposal is tendered, the same would be considered on its own merits and in the light of the view set out in Dattatry Devidas Sonwale (supra).

Needless to state, the payment of salary from the Government salary grants would be effected prospectively, only from the date when the Petitioner clears the TET/CTET examination.
