Mr. Sathe, learned senior counsel appearing for respondent No. 9, has tendered a compilation of documents. The same is taken on record.

After arguing for some time, when we were not inclined to entertain the petition, since the petitioner is already pursuing Regular Civil Suit No. 357/2006 before the 9th Joint Civil Judge, Senior Division, Pune, the learned counsel for the petitioner sought leave to withdraw the petition, with liberty to pursue the remedies available to the petitioner and already being pursued by the petitioner.

Learned counsel for the petitioner, on instructions, further states that the petitioner voluntarily undertakes to deposit a sum of Rs.1,00,000/- with the Bar Council of Maharashtra and Goa Advocate Aid Fund, within one week from today, for suppression of certain facts. The said statement is accepted. The petition is accordingly dismissed as withdrawn, with liberty as prayed. Needless to state that, all contentions of all parties on merits are kept open.
