We find that the Petitioner has already taken a recourse to the remedy by filing a civil suit being Regular Civil Suit No.192 of 2025 as filed before the Court of Civil Judge, Senior Division, Thane. 2.

Learned Counsel for the Petitioner fairly states that all contentions to be raised by the Petitioner in the pending Suit necessarily be included by amending the Plaint. The Petitioner is free to do so.

The Writ Petition is accordingly need not be entertained. The same is accordingly disposed of keeping open all contentions of the parties. No costs. 4.

Needless to observe that if the Petitioner intends to move any urgent ad interim application in the Suit, the same be considered by the Learned Civil Judge at utmost priority.
