This petition is filed by defendant no.1 to modify the order dated 4th March 2025, permitting him to amend the written statement on payment of cost of Rs. 5000/-. The review application filed by the petitioner is rejected on the ground that the hearing of the suit is expedited by this court and defendant no.1 is trying to prolong the hearing.

This is not a case to interfere with the impugned order in the discretionary jurisdiction under Article 227 of the Constitution of India. It is therefore, clarified that the observations made in both the orders, have been made for a limited purpose of deciding the applications. All contentions on merits will remain open at the Page no. 1 of 2

36-wp-6673-2025.doc time of final hearing of the suit.

Hence, the petition is dismissed.
