This petition is filed by one of the bidders who has made the second lowest bid. The grievance of the petitioner is that the objection filed by the petitioner on 6th March 2025 raising a dispute about the document and eligibility of the lowest bidder had not been dealt with and decided upon by respondent no.2. Learned counsel for the petitioner relies upon clause 6.1(iv) of the tender document which permits the bidder to raise such an objection. Page no. 1 of 2

Learned Additional Government Pleader seeks time to take instructions on whether the objection is decided. He submits that he shall file an affidavit-in-reply to the petition, giving particulars regarding the decision if any on the objection. He submits that if any decision is taken, a copy of the decision shall be attached to the affidavit-in-reply.

Affidavit-in-reply tendered on behalf of respondent no.3 is taken on record. Learned Additional Government Pleader is permitted to file the necessary affidavit-in-reply on or before 6th June 2025, with an advance copy to the learned advocate for the petitioner.

List the petition on 9th June 2025.

Till the next date the final decision regarding awarding the contract shall not be taken.
